Once-doomed, NY's Grand Central turns 100 as celebrated landmark

NEW YORK (Reuters) - It made its debut in the heyday of cross-country train travel, faced demolition in the era of the auto, and got a new lease on life with a facelift in its eighth decade.

Now Grand Central Terminal, the doyenne of American train stations, is celebrating its 100th birthday.

Opened on February 2, 1913, when trains were a luxurious means of traveling across America, the iconic New York landmark with its Beaux-Arts facade is an architectural gem, and still one of America's greatest transportation hubs.

It is also the Big Apple's second-most-popular tourist attraction, after Times Square.

"We are among the top 10 most-visited sites in the world," boasted Dan Brucker, manager of Grand Central Tours at Metro-North Railroad, the commuter rail service that operates from Grand Central.

"Every day more than 750,000 people come through Grand Central Terminal - that is the entire population of Alaska that walks through here every day. It is the entire population of the state of North Dakota," he noted.

Many are commuters who arrive on trains every 58 seconds at the peak of the morning rush, pouring onto the terminal's dozens of platforms. Tourists gasp at the vaulted ceiling and sprawling 22,000-square-foot marble concourse, which has doubled as a film set for movies such as "The Fisher King" and "The Cotton Club." And thousands from both groups eat and shop at any of the 103 restaurants and stores.

"There are a lot of beautiful old train stations in this country but none as big, and none as ornate, and none as elevated and well-known as Grand Central," said Gabrielle Shubert, the director of New York Transit Museum.

HARDSHIPS, RENOVATIONS AND SECRETS

The February 2 anniversary will mark the start of year-long celebrations commemorating the centennial with exhibitions, performances, promotions and public events.

Since its beginnings in 1913, when Grand Central was dubbed the greatest railway terminal in the world with an $80 million price tag, it has been an integral part of New York.

In its early heyday Grand Central was a center of culture, with an art gallery, theater and tennis court, as well as a commerce hub with travelers boarding trains like the Yankee Clipper and the 20th Century Limited for luxurious long-distance trips.

"As early as 1929 there were individually controlled air conditioning in the staterooms," said Brucker, adding that chefs and hairdressers traveled with the well-heeled clientele.

But following World War Two, as government subsidies helped build airports and improve roads, the Golden Age of rail travel lost its luster, relegated to the status of dowdy old-timer as planes and autos took the forefront in travel, propelled by speed and lower prices.

During the ensuing decades Grand Central deteriorated, property prices in New York rose dramatically and plans were commissioned to demolish the terminal.

But a reprieve, spearheaded by former first lady Jacqueline Kennedy Onassis, led to its designation in 1976 as a National Historic Landmark, a decision upheld by the U.S. Supreme Court.

By 1991 long-distance trains had stopped serving Grand Central, and Metro-North Railroad, which had been created a decade earlier to consolidate operates four lines into the terminal, had become the country's largest regional railroad.

A two-year restoration began in 1996 that returned the terminal to its former glory. Every detail, from the acorn motifs emblem of the Vanderbilt family who built it, to the marble walls and floors, and chandeliers, was meticulously replicated. More than $1 million was spent cleaning the black-stained ceiling.

"This place was redone perfectly to the way it looked in 1913," according to Brucker.

But just as impressive as its public face are the secrets of the terminal: the underground tracks; unmapped cellar, which is the largest in New York; the secret station, hidden staircase and crosswalks in the massive east- and west-facing windows.

"It was the power source for all the buildings around. Underneath Grand Central is steam production and electric production that powered not just the building itself but all the buildings around it. That's unique," said the Transit Museum's Shubert.

On Grand Central's lower level, the famous domed whispering gallery transmits soft sound across the arc of the ceiling, enabling visitors to whisper to each other from diagonal corners.

"Here is this country we don't have piazzas and plazas where people congregate," Shubert said. "We have Grand Central. People seem to amass themselves in Grand Central to mourn, to celebrate, to get news when there is a crisis going on.

"This is the only indoor space where people gather to share many moments of humanity."

They?re worth watching, even if you have no interest at all in sports, tech, or video games.

China sentences two Tibetans for "inciting" self-immolations

BEIJING (Reuters) - A court in China has handed down heavy sentences to a Tibetan monk and his nephew for inciting eight people to set themselves on fire in anti-Chinese protests, media said on Thursday, the first time punishment has been meted out over such protests.

Nearly 100 Tibetans have set themselves on fire to protest against Chinese rule since 2009, with most of them dying from their injuries.

Lorang Konchok, 40, was sentenced to death with a two-year reprieve in the Aba prefecture in Sichuan province, while his nephew, Losang Tsering, 31, was sentenced to 10 years in prison, the Xinhua state news agency said.

In practice, a death sentence with a two-year reprieve is commuted to life imprisonment or reduced to a fixed-term later.

"The two incited and coerced eight people to self-immolate, resulting in three deaths," Xinhua said, citing the Intermediate People's Court in Aba prefecture.

Last December, Xinhua reported that Lorang Konchok, who was detained with his nephew in August, confessed to police that he had followed instructions from exiled Tibetan spiritual leader the Dalai Lama and his followers.

Lorang Konchok and his nephew passed on information about each self-immolation, including photographs, to overseas contacts belonging to a Tibetan independence organisation with mobile telephones, Xinhua said.

China has repeatedly denounced the Dalai Lama and exiled Tibetan groups for fomenting the self-immolations.

Beijing considers Nobel peace laureate the Dalai Lama, who fled from China in 1959 after an abortive uprising against Chinese rule, a separatist. The Dalai Lama says he is merely seeking greater autonomy for his Himalayan homeland.

He has called on China to investigate the self-immolations. He has said he is not encouraging them has called them "understandable".

China has defended its iron-fisted rule in Tibet, saying the remote region suffered from dire poverty, brutal exploitation and economic stagnation until 1950, when Communist troops "peacefully liberated" it.

Tibetan areas in China have been largely closed to foreign reporters, making an independent assessment of the situation there impossible.

Chinese police arrested a Tibetan man last week for allegedly encouraging a monk to burn himself to death, as part of a new tactic to discourage suicide protests against Chinese rule.

David Lee, Golden State Warriors

The now two-time All-Star Lee is currently tied for sixth in rebounding and is the 12th-leading scorer in the league, averaging 19.6 ppg and 10.9 rpg. This past week, Lee recorded at least 20 points in all five of Golden State?s games. He also had four doubles-doubles.

Mike Miller, Miami Heat

In 37 games, Miller is averaging 3.8 ppg and 2.3 rpg. Last week, Miller played in two games for Miami, scoring two points and pulling down five rebounds.

Joakim Noah, Chicago Bulls

The first-time All-Star Noah had a monstrous week on the boards last week, averaging an absurd 17.3 rpg in four games. With this amazing stretch, he raised his rebounding average 0.6 ppg and is now ranked third in the league in rebounding. Along with Lee, Noah is one of nine players in the league to be averaging a double-double (12.1 ppg and 11.3 rpg).

Chandler Parsons, Houston Rockets

Parsons is averaging 14.1 ppg, 5.8 rpg, and 3.6 apg for Houston in 46 games this year. He scored in double figures in three of four games this past week. Parsons also tallied a double-double, 16 points and a career-best 11 assists, for his first double-double of that variety in his career.

Marresse Speights, Cleveland Cavaliers

Since joining Cleveland last week, Speights has found his scoring touch. He has scored at least 10 points in every game he has played in for the Cavaliers. Speights is averaging 7.0 ppg and 4.8 rpg this season.

LOS ANGELES (AP) ? Now it's time to say goodbye to "Epic Mickey."

The interactive division of the Walt Disney Co. announced Tuesday that it is closing Junction Point Studios, its Austin, Texas-based developer that created 2010's "Disney Epic Mickey" and its 2012 sequel "Epic Mickey 2: The Power of Two."

Disney said the closure is part of its "effort to address the fast-evolving gaming platforms and marketplace" and to align its resources with its key priorities.

"We're extremely grateful to Warren Spector and the Junction Point team for their creative contributions to Disney with 'Disney Epic Mickey' and 'Disney Epic Mickey 2,'" the studio said in a statement.

Disney acquired Junction Point in 2007. The studio was led by "Deus Ex" and "Thief" creator Warren Spector.

Both "Epic Mickey" games were set in a twisted version of Disneyland called Wasteland and featured Mickey Mouse and Oswald the Lucky Rabbit as protagonists.

"I said to myself as Junction Point embarked on the 'Epic Mickey' journey that, worst case, we'd be 'a footnote in Disney history,'" Spector posted Monday on Facebook. "Looking back on it, I think we did far better than that. With Mickey Mouse as our hero, we introduced a mainstream audience to some cool 'core game' concepts ? and, most especially, we restored Oswald the Lucky Rabbit to a place of prominence."

The first "Epic Mickey," which was released only for the Nintendo Wii, was the sixth best-selling game the month it was released in 2010. "Epic Mickey 2," which was available for the Wii, as well as the Sony PlayStation 3 and Microsoft's Xbox 360, didn't crack the top 10 when it was released last November, according to gaming industry tracker NPD Group.

Disney unveiled plans earlier this month for a new franchise combining a toy line and a game called "Disney Infinity," similar to "Skylanders" from Activision-Blizzard Inc. "Infinity" is being developed by Disney's Salt Lake City, Utah-based developer Avalanche Software and is set to debut in June alongside "Monsters University," the 3-D prequel to the 2001 Disney-Pixar film "Monsters Inc."

Study sees prostate cancer treatment side effects

A new study shows how important it is for men to carefully consider treatments for early-stage prostate cancer. Fifteen years after surgery or radiation treatment, nearly all of the older men in the study had some problems having sex.

About one-fifth had bladder or bowel trouble, researchers found.

The study doesn't compare these men - who were 70 to 89 at the end of the study - to others who did not treat their cancers or to older men without the disease. At least one study suggests that half that age group has sexual problems even when healthy.

The study isn't a rigorous test of surgery and radiation, but it is the longest follow-up of some men who chose those treatments.

Since early prostate cancers usually don't prove fatal but there are no good ways to tell which ones really need treatment, men must be realistic about side effects they might suffer, said one study leader, Dr. David Penson of Vanderbilt University.

"They need to look at these findings and say, `Oh my gosh, no matter what I choose, I'm going to have some quality-of-life effect and it's probably greater than my doctor is telling me,'" he said.

The study appears in Thursday's New England Journal of Medicine.

Prostate cancer is the most common cancer in American men. In the United States alone, there were about 240,000 new cases and 28,000 deaths from the disease last year. Radiation or surgery to remove the prostate are common treatments when the disease is confined to the gland.

Men usually live a long time after treatment - 14 years on average - so it's important to see how they fare, said another study leader, Vanderbilt's Dr. Matthew Resnick.

The study involved 1,655 men diagnosed in 1994 or 1995, when they were ages 55 to 74. About two-thirds of them had surgery and the rest, radiation. They were surveyed two, five and 15 years later. By that time, 569 had died.

Men who had surgery had more problems in the first few years after their treatments than those given radiation, but by the end of the study, there was no big difference.

After 15 years, 18 percent of the surgery group and 9 percent of the radiation group reported urinary incontinence, and 5 percent of the surgery group and 16 percent of the radiation group said they were bothered by bowel problems. But the differences between the two groups could have occurred by chance alone once researchers took other factors such as age and the size of the men's tumors into account.

Impotence was "near universal" at 15 years, the authors write - 94 percent of the radiation group and 87 percent of the surgery group. But the difference between the groups also was considered possibly due to chance. Also, less than half of men said they were bothered by their sexual problems.

"These men do get some help from pills like Viagra, Cialis, Levitra," but it may not be as much as they would like and most men would rather not need those pills, Penson said.

The National Cancer Institute paid for the study. Two authors have consulted for several makers of prostate cancer treatment drugs.

No study is perfect and this one has many limitations, said Dr. Timothy Wilson, urology chief at City of Hope, a cancer center in Duarte, Calif. Men who are having problems are more likely to complete follow-up surveys because they're angry, so that could skew results, he noted.

Still, "it's a high percentage" with side effects, said Wilson, who has been a paid speaker for two makers of surgery equipment.

"There's no question we overtreat" many cases of early prostate cancer, yet the disease is still the second-leading cause of cancer deaths in men. "We need to better sort out who really needs treatment," he said.

Olympus is carrying on the recent compact camera trend of fast-ish zoom lenses and wireless sharing capability with the launch of the 12-megapixel Stylus XZ-10. The new model follows in the footsteps of the company's top compact dog XZ-2 model, sporting a slightly smaller 1/2.3-inch sensor and a wider range 5x optical zoom with a similar f/1.8-2.7 iris. POSCO Q4 profit slumps, warns of 10 pct cut in 2013 sales

SEOUL (Reuters) - POSCO , the world's No.5 steelmaker by output, reported a 51 percent slump in quarterly operating profit as tepid demand and falling prices offset lower raw material costs helped by a firmer local currency.

The South Korean steelmaker on Tuesday forecast its 2013 sales may drop 10 percent to 32 trillion won ($29.3 billion), but said it would raise investment 11 percent to 4 trillion won this year to stay competitive.

POSCO, backed by billionaire investor Warren Buffett, said that its operating profit for October to December fell 51 percent to 379 billion won ($346.7 million) on a parent basis that does not reflect earnings of affiliates from a year earlier, below a consensus forecast of 490 billion won in a Reuters' poll of 25 analysts.

The fourth-quarter result compared with a 771 billion won operating profit a year earlier. Fourth-quarter sales fell 20 percent to 8.07 trillion won, compared with a consensus forecast of 8.35 trillion won.

POSCO has been posting higher margins than its bigger peers ArcelorMittal SA , Nippon Steel & Sumitomo Metal Corp , backed by its dominant position in the domestic market and its cost efficiency.

POSCO has not been immune to a prolonged industry downturn as the weak global economy has hurt demand and prices for the alloy used in the automobile, shipbuilding, construction and home appliance sectors.

Recent economic data from China points to the recovery of the world's top steel consumer this year after the economy grew at the weakest pace in 13 years last year. But the rebound would be a tepid 8.1 percent, with Europe's debt crisis and a slow U.S. recovery weighing on exports, a Reuters poll showed last week.

"The global race for survival will be fiercer than ever this year," POSCO CEO Chung Joon-yang said in a statement, adding he expects the global economy to remain sluggish despite moderate recovery in China and the United States.

Shares in POSCO, 5 percent owned by Warren Buffett's Berkshire Hathaway

, ended down 0.1 percent prior to the results, after rebounding since late November on hopes China's economy will recover.

STRONGER WON: BAD OR GOOD?

Byun Jong-man, an analyst at Woori Investment & Securities, said the appreciation of the South Korean won helped reduce POSCO's import costs of iron ore and coking coal in the fourth quarter.

POSCO's costs of iron ore and coking coal declined by nearly a third to 357,000 Korean won per tonne in the fourth quarter from 519,000 won, according to estimates by Mirae Asset Securities.

The stronger South Korean won would do more good than harm for the steelmaker in the near term, "given its bigger raw material imports than steel product exports," according to Sinn Min-seok, an analyst at Credit Suisse. POSCO's exports accounted for 42 percent of its sales volume in the third quarter of last year.

The South Korean won rose almost 8 percent against the U.S. dollar last year, its fastest pace since 2009 and Credit Suisse estimated the appreciation of every 10 won against a dollar would increase POSCO's annual operating profit by 40 billion won.

But the stronger won threatens to hurt steel demand from automakers and other exporters for the longer term, the brokerage said.

APPETITE FOR M&A

POSCO's CEO Chung has spearheaded major investments and acquisitions, including the purchase of trading and resources firm Daewoo International for 3.37 trillion won in 2010, leaving the steel giant with heavy debts and leading to a series of rating cuts by Moody's, S&P and Fitch last year.

POSCO has been struggling to cut debt by selling assets of its affiliates, but in a setback, its unit POSCO Specialty Steel, canceled a plan to list shares worth up to $424 million on the stock market because of tepid demand from investors.

POSCO is continuing its efforts to snap up overseas resources to secure stable supplies of iron ore and coking coal.

A consortium including POSCO and Taiwan-listed China Steel Corp agreed to buy a 15 percent stake in ArcelorMittal Mines Canada for $1.1 billion.

Another group including POSCO was also open to resuming $1.2 billion bid talks with Australian mining firm Arrium Ltd , a source told Reuters early November, after the consortium, which also includes Noble Group Ltd , had dropped the bid on price differences.

Cats killing 'billions of animals'

Cats are one of the top threats to US wildlife, killing billions of animals each year, a study suggests.

The authors estimate they are responsible for the deaths of between 1.4 and 3.7 billion birds and 6.9-20.7 billion mammals annually.

Writing in Nature Communications, the scientists said stray and feral cats were the worst offenders.

However, they added that pet cats also played a role and that owners should do more to reduce their impact.

The authors concluded that more animals are dying at the claws of cats in the United States than in road accidents, collisions with buildings or poisonings.

The domestic cat's killer instinct has been well documented on many islands around the world.

Felines accompanying their human companions have gone on to prey on the local wildlife, and they have been blamed for the global extinction of 33 species.

But their impact on mainland areas has been harder to chart.

To find out more, researchers from the Smithsonian Conservation Biology Institute (SCBI) and the US Fish and Wildlife Service carried out a review of studies that had previously looked at the predatory prowess of cats.

Their analysis revealed that the cat killings were much higher than previous studies had suggested: they found that they had killed more than four times as many birds as has been previously estimated.

Birds native to the US, such as the American Robin, were most at risk, and mice, shrews, voles, squirrels and rabbits were the mammals most likely to be killed.

Dr Pete Marra from the SCBI said: "Our study suggests that they are the top threat to US wildlife."

The team said that "un-owned" cats, which they classified as strays, feral cats and farm cats, were killing about three times as many animals as pet cats. However, they said pet cats were still killing significant numbers of animals, and that their owners should do more to limit the impact.

Dr Marra said: "We hope that the large amount of wildlife mortality indicated by our research convinces some cat owners to keep their cats indoors and that it alerts policymakers, wildlife managers and scientists to the large magnitude of wildlife mortality caused by cat predation."

A spokeswoman for the animal welfare charity the RSPCA said that a properly fitted collar and bell could reduce a cat's success when hunting by at least a third.

CLEVELAND (AP) ? Greg Oden's next comeback could be with the Cavaliers.

A person with knowledge of Cleveland's interest said the team is exploring the possibility of signing Oden, the former No. 1 overall pick whose NBA career has been sabotaged by injuries.

The Cavs are doing their due diligence while looking at Oden, said the person who spoke to The Associated Press on condition of anonymity Tuesday because the team's interest is contingent upon the center's health.

CBSSports.com first reported the Cavs and Miami Heat were leading the pursuit of Oden, who hasn't played since 2009 and has undergone three microfracture knee surgeries ? two on his left knee.

Before watching No. 11 Ohio State's 58-49 win over Wisconsin on Tuesday night in Columbus, Ohio, Oden said he hopes to be healthy enough to take another shot at pro ball.

"I don't know when, but I'm taking this year off. I'll play next year," said Oden, who led the Buckeyes to the Final Four as a freshman in 2007.

Oden's agent, Mike Conley Sr., could not be reached for comment.

A defensive force during his one college season, the 7-foot Oden was the first player taken in the 2007 draft by Portland, who chose the soft-spoken big man over All-Star Kevin Durant. Oden was limited to just 82 games with the Trail Blazers, averaging 9.2 points and 7.3 rebounds. Oden has not played since 2009, and he had his last operation on Feb. 20 last year.

Portland waived Oden last March, ending a troubled five-year run with a player who entered the league with superstar potential.

Any team that signs the 25-year-old Oden would be taking a risk. But for a rebuilding team like the Cavs, who are looking to add pieces around All-Star point guard Kyrie Irving, the possibility Oden could develop into a productive player is enticing.

Oden said he has no preference on which team he plays for.

"Right now I'm not worrying about where," he said. "I'm only worried about my knee."

Soderbergh, Van Sant to show at Berlin film fest

BERLIN (AP) ? New movies from directors Steven Soderbergh and Gus Van Sant and a trio of films starring French divas will be competing this year at the Berlin International Film Festival.

A diverse selection of 19 movies ? including films from Kazakhstan and Iran ? will vie for the main Golden Bear prize at Europe's first major film festival of the year.

Van Sant's film about the shale gas industry, "Promised Land," and Soderbergh's thriller "Side Effects" are the most prominent U.S. offerings. There's a strong contingent from eastern Europe, including Oscar-winning Bosnian director Danis Tanovic's "An Episode in the Life of an Iron Picker" about a poor Gypsy family.

French actresses Juliette Binoche, Catherine Deneuve and Isabelle Huppert all star in separate competition entries.

The festival runs Feb. 7-17.

Bullying Makes Middle Schoolers Cool

Anti-bullying campaigns might be tough to enforce in middle schools, because nasty behavior, whether it's picking fights or spreading ugly rumors, seems to boost kids' popularity, new research shows.

A group of psychologists studied nearly 2,000 students at 11 middle schools in Los Angeles. They conducted surveys in the spring of seventh grade and the fall and spring of eighth grade; participants named their peers who were considered the "coolest," as well as those who "start fights or push other kids around," and those who "spread nasty rumors about other kids."

Often, the students who ranked coolest at one point were named among the most aggressive during the next survey, the researchers said. Conversely, the ones thought to be most aggressive went on to rank among the most popular.

"The ones who are cool bully more, and the ones who bully more are seen as cool," study researcher Jaana Juvonen, a UCLA professor of psychology, said in a statement. "What was particularly interesting was that the form of aggression, whether highly visible and clearly confrontational or not, did not matter. Pushing or shoving and gossiping worked the same for boys and girls."

The findings are in partial agreement with previous studies that showed popular kids are most likely to act aggressively toward other kids.

The new study, detailed in the February edition of the Journal of Youth and Adolescence, suggests anti-bullying programs need to be more subtle to succeed. Juvonen said campaigns should focus on bystanders, showing them how their tacit approval allows bullies to thrive. Other research has shown that bullies choose their victims wisely, often targeting kids who are unpopular and less likely to be defended by onlookers.

Green Blog: A Solar-Powered Shed for India's Perishable Food

Milk? Garbage. Spinach? Garbage. Leftover Thai takeout? Garbage. For millions in the Northeast, clearing out the fridge after days without power was just one more unsavory chore that was part of the cleanup process after Hurricane Sandy passed through.

But in the developing world, throwing out food because of inadequate refrigeration isn?t just annoying, it?s a devastating and irreparable economic blow that keeps farmers trapped at the level of subsistence and threatens food security. In India, the government estimates that anywhere from 30 to 40 percent of food spoils long before it finds its way to the table.

Such waste is endemic because so few farmers have access to electricity. Even in Tamil Nadu, one of the most industrialized states in the country and sometimes referred to as India?s California, only 40 percent of the population has electricity. Without power, tomatoes and okra stand no chance in 104-degree weather.

To address the problem, business students and engineers from the University of Cincinnati have teamed with local Ohio companies to create a small solar-powered refrigerated shed for storing food. The SolerCool container runs on just eight solar panels and keeps produce at a comfortably cool temperature, even at night, thanks to a battery that charges during the day.

Mohsen Rezayat, chief solutions architect at Siemens PLM and an adjunct professor in the University of Cincinnati?s engineering school, helped bring all the technology for the shed together. One of its more unusual components is the compressor.

?Compressors, which generate the cold air for refrigeration, are huge energy hogs,? Dr. Rezayat noted. But the team found a company that had created a small portable one that could be run on the power from just a few solar panels.

The unit was designed so that vending machines wouldn?t have to be hauled out for repair, he said. ?When something went wrong with the cooling system, a new one could just be popped in like a fresh ink cartridge,? Dr. Rezayat explained. ?Turns out, what?s good for vending machines at universities in Ohio is good for cabbages on farms in India.?

For now, the cold shed costs about $5,000, a price that the Ohio team knows is well beyond the reach of most small farmers.

?At the moment the price means that several farms would have to pool resources and share one unit,? Dr. Reyazat said. ?We are very price-conscious and are looking at ways to bring the price down to really help the poorest of the poor increase their earning potential.? One possibility is to manufacture some smaller units for farmers with just a few acres.

In the meantime, a field prototype is on its way to an aloe farm near Pune, India, to see if it performs as well in that climate as it does in Ohio.

NYC pulling down 'Don't Honk' signs

NEW YORK (AP) ? New York City's "Don't Honk" signs are coming down, but it's still against the law to blow a car horn unnecessarily.

The city Department of Transportation says all the signs will be removed by the end of the year.

According to The New York Times (http://nyti.ms/117Avza ), city officials say the decision is part of an effort to de-clutter the streets of signs that generally go ignored.

Unnecessary honking carries a $350 fine but is rarely enforced.

The DOT says complaints about honking have declined 63 percent since 2008.

But City Councilwoman Gale Brewer said in a letter to the DOT: "I can't tell you how many requests I get for 'no honking' signs."

The signs were introduced during Mayor Ed Koch's administration.

Bipartisan Framework for Comprehensive Immigration Reform

Senators Schumer, McCain, Durbin, Graham, Menendez, Rubio, Bennet, and Flake

Introduction

We recognize that our immigration system is broken. And while border security has improved significantly over the last two Administrations, we still don?t have a functioning immigration system. This has created a situation where up to 11 million undocumented immigrants are living in the shadows. Our legislation acknowledges these realities by finally committing the resources needed to secure the border, modernize and streamline our current legal immigration system, while creating a tough but fair legalization program for individuals who are currently here. We will ensure that this is a successful permanent reform to our immigration system that will not need to be revisited.

Four Basic Legislative Pillars:

o Create a tough but fair path to citizenship for unauthorized immigrants currently living in the United States that is contingent upon securing our borders and tracking whether legal immigrants have left the country when required;

o Reform our legal immigration system to better recognize the importance of characteristics that will help build the American economy and strengthen American families;

o Create an effective employment verification system that will prevent identity theft and end the hiring of future unauthorized workers; and,

o Establish an improved process for admitting future workers to serve our nation?s workforce needs, while simultaneously protecting all workers.

I. Creating a Path to Citizenship for Unauthorized Immigrants Already Here that is Contingent Upon Securing the Border and Combating Visa Overstays

? Our legislation will provide a tough, fair, and practical roadmap to address the status of unauthorized immigrants in the United States that is contingent upon our success in securing our borders and addressing visa overstays.

? To fulfill the basic governmental function of securing our borders, we will continue the increased efforts of the Border Patrol by providing them with the latest technology, infrastructure, and personnel needed to prevent, detect, and apprehend every unauthorized entrant.

? Additionally, our legislation will increase the number of unmanned aerial vehicles and surveillance equipment, improve radio interoperability and increase the number of agents at and between ports of entry. The purpose is to substantially lower the number of successful illegal border crossings while continuing to facilitate commerce.

? We will strengthen prohibitions against racial profiling and inappropriate use of force, enhance the training of border patrol agents, increase oversight, and create a mechanism to ensure a meaningful opportunity for border communities to share input, including critiques.

? Our legislation will require the completion of an entry-exit system that tracks whether all persons entering the United States on temporary visas via airports and seaports have left the country as required by law.

? We recognize that Americans living along the Southwest border are key to recognizing and understanding when the border is truly secure. Our legislation will create a commission comprised of governors, attorneys general, and community leaders living along the Southwest border to monitor the progress of securing our border and to make a recommendation regarding when the bill?s security measures outlined in the legislation are completed.

? While these security measures are being put into place, we will simultaneously require those who came or remained in the United States without our permission to register with the government. This will include passing a background check and settling their debt to society by paying a fine and back taxes, in order to earn probationary legal status, which will allow them to live and work legally in the United States. Individuals with a serious criminal background or others who pose a threat to our national security will be ineligible for legal status and subject to deportation. Illegal immigrants who have committed serious crimes face immediate deportation.

? We will demonstrate our commitment to securing our borders and combating visa overstays by requiring our proposed enforcement measures be complete before any immigrant on probationary status can earn a green card

? Current restrictions preventing non-immigrants from accessing federal public benefits will also apply to lawful probationary immigrants.

? Once the enforcement measures have been completed, individuals with probationary legal status will be required to go to the back of the line of prospective immigrants, pass an additional background check, pay taxes, learn English and civics, demonstrate a history of work in the United States, and current employment, among other requirements, in order to earn the opportunity to apply for lawful permanent residency. Those individuals who successfully complete these requirements can eventually earn a green card.

? Individuals who are present without lawful status ? not including people within the two categories identified below ? will only receive a green card after every individual who is already waiting in line for a green card, at the time this legislation is enacted, has received their green card. Our purpose is to ensure that no one who has violated America?s immigration laws will receive preferential treatment as they relate to those individuals who have complied with the law.

? Our legislation also recognizes that the circumstances and the conduct of people without lawful status are not the same, and cannot be addressed identically.

o For instance, individuals who entered the United States as minor children did not knowingly choose to violate any immigration laws. Consequently, under our proposal these individuals will not face the same requirements as other individuals in order to earn a path to citizenship.

o Similarly, individuals who have been working without legal status in the United States agricultural industry have been performing very important and difficult work to maintain America?s food supply while earning subsistence wages. Due to the utmost importance in our nation maintaining the safety of its food supply, agricultural workers who commit to the long term stability of our nation?s agricultural industries will be treated differently than the rest of the undocumented population because of the role they play in ensuring that Americans have safe and secure agricultural products to sell and consume. These individuals will earn a path to citizenship through a different process under our new agricultural worker program.

II. Improving our Legal Immigration System and Attracting the World?s Best and Brightest

? The development of a rational legal immigration system is essential to ensuring America?s future economic prosperity. Our failure to act is perpetuating a broken system which sadly discourages the world?s best and brightest citizens from coming to the United States and remaining in our country to contribute to our economy. This failure makes a legal path to entry in the United States insurmountably difficult for well-meaning immigrants. This unarguably discourages innovation and economic growth. It has also created substantial visa backlogs which force families to live apart, which incentivizes illegal immigration.

? Our new immigration system must be more focused on recognizing the important characteristics which will help build the American economy and strengthen American families. Additionally, we must reduce backlogs in the family and employment visa categories so that future immigrants view our future legal immigration system as the exclusive means for entry into the United States.

? The United States must do a better job of attracting and keeping the world?s best and brightest. As such, our immigration proposal will award a green card to immigrants who have received a PhD or Master?s degree in science, technology, engineering, or math from an American university. It makes no sense to educate the world?s future innovators and entrepreneurs only to ultimately force them to leave our country at the moment they are most able to contribute to our economy.

III. Strong Employment Verification

? We recognize that undocumented immigrants come to the United States almost exclusively for jobs. As such, dramatically reducing future illegal immigration can only be achieved by developing a tough, fair, effective and mandatory employment verification system. An employment verification system must hold employers accountable for knowingly hiring undocumented workers and make it more difficult for unauthorized immigrants to falsify documents to obtain employment. Employers who knowingly hire unauthorized workers must face stiff fines and criminal penalties for egregious offenses.

? We believe the federal government must provide U.S. employers with a fast and reliable method to confirm whether new hires are legally authorized to work in the United States. This is essential to ensure the effective enforcement of immigration laws.

? Our proposal will create an effective employment verification system which prevents identity theft and ends the hiring of future unauthorized workers. We believe requiring prospective workers to demonstrate both legal status and identity, through non-forgeable electronic means prior to obtaining employment, is essential to an employee verification system; and,

? The employee verification system in our proposal will be crafted with procedural safeguards to protect American workers, prevent identity theft, and provide due process protections.

IV. Admitting New Workers and Protecting Workers? Rights

? The overwhelming majority of the 327,000 illegal entrants apprehended by CBP in FY2011 were seeking employment in the United States. We recognize that to prevent future waves of illegal immigration a humane and effective system needs to be created for these immigrant workers to enter the country and find employment without seeking the aid of human traffickers or drug cartels.

? Our proposal will provide businesses with the ability to hire lower-skilled workers in a timely manner when Americans are unavailable or unwilling to fill those jobs.

? Our legislation would:

o Allow employers to hire immigrants if it can be demonstrated that they were unsuccessful in recruiting an American to fill an open position and the hiring of an immigrant will not displace American workers;

o Create a workable program to meet the needs of America?s agricultural industry, including dairy to find agricultural workers when American workers are not available to fill open positions;

o Allow more lower-skilled immigrants to come here when our economy is creating jobs, and fewer when our economy is not creating jobs;

o Protect workers by ensuring strong labor protections; and,

o Permit workers who have succeeded in the workplace and contributed to their communities over many years to earn green cards.

The Decline of the United States Dollar - The Day Trading Academy

The decline of the American dollar is still rapidly in motion as a set of fiscal and spending policies by the American federal government create a perfect monetary and economic storm.

The continued strength of the dollar at the end of 2012 is more a symptom of the weakness and in one case the non-convertibility of other currencies.

As much as a number of countries would like to disembark from the American dollar the alternatives are not plausible given present economic conditions throughout the world. The Euro is going through its own crisis and without the strength of the German economy it would be in a much more tenuous position than it already is.

As much talk as there was about the resurgent economy of Japan in the 1980?s the decade of no growth that followed and structural problems with the Japanese economy has made the yen unlikely as a reserve currency.

US Dollar

The British pound has not been in a position of real authority since the run on the pound in the 1960?s.

China?s yen is not yet fully convertible and the other rising economies like Brazil, Russia or India do not have the economic strength nor size to compete with the dollar on a global scale.

The worlds continued reliance on the United States to be the world?s medium of exchange for trade especially in commodities has given Americans a tremendous advantage over the years. It has allowed the United States to run huge trade and balance of payments deficits for years.

Companies and investors from overseas are paid in a currency that continues to lose value just as the pools of this currency grow ever larger. Americans continue to think that their reckless economic and monetary policy has few consequences but they are about to find out that there are no proverbial free lunches.

A rapid decline in value of the American dollar will have far reaching effects to Americans everywhere.

The Bretton Woods Agreement of the 1940?s which fixed the international exchange rate of the major currencies of the world finally came undone in 1971.? The United States had recklessly decided to expand social programs at home and pay for a war abroad through accumulation of government debt.

The result was an inflationary spiral and a rapid decline in real terms of the dollar.? Since exchange rates were fixed it obliged other countries to finance part of the cost of this economic behavior during the Johnson Administration.

By the Nixon Administration the situation had become untenable for many countries particularly in Europe.

The way to call ?America?s bluff? to coin a phrase would be to demand payment in something more tangible than the American dollar.

At the time the world was on the gold standard and the dollar was supposed to be worth 35 dollars an ounce.? The run on America?s gold reserves had begun.? Although it was the French who initiated the strike against the value of the dollar it was poor economic management of American finances by the United States government that led to this result.

The issue had to be resolved sooner or later regardless because other countries had no long term interest in funding American endeavors at home and abroad.

The result was the disastrous inflationary economy of the 1970?s which was of course exacerbated by oil embargoes and conflict abroad.? The United States had no choice but to abandon the gold standard and allow a floating exchange of international currency.? The alternative was a dramatic cut in federal spending that the politicians in Washington were not willing to push forward.

The American government did not get a handle on this downward spiral until the advent of the Reagan Administration in the 1980?s.

Although inflation was wrung out of the economy by high interest rates and renewed growth; a continuing problem was the increase in government debt and the rising cost of servicing that debt.

It is true that tax cuts and deregulation of business interests during these years vastly expanded economic growth but government spending rose even faster despite the increased inflow of money to the American treasury.

Again the United States had decided to fund a rapid increase in military expenditures to win the Cold War which was championed by a Republican administration. At the same time there was no slowdown in social spending on the Congressional side which was mostly in the hands of the Democrats during these years.

During the Clinton years of the 1990?s you had the reverse.

A Democratic administration that wanted to spend more and saw government deficits as far as the eye could see and a Republican Congress that wanted to curb it.? Yes there was politics behind it; not wanting a popular president to gain even more political strength by increased social spending.

The result was a federal government balance between taxes and expenditures and even a ?surplus? by the end of the Clinton Administration.

I hesitate to use the word surplus because if you included federal obligations, future liabilities, and federal debt already accumulated there was no real surplus but it was a big step in the right direction of fiscal prudence and responsibility.

It will be the first painful step that the United States government will need to achieve once again, if there is any hope in saving the American dollar and prevent its collapse.

Given the present impasse between the different branches of the United States government that seems highly unlikely.

In a later article we will discuss the disastrous federal government policy of running trillion dollar plus budget deficits on a yearly basis and a massive expansion of future entitlements and liabilities that number into the hundreds of trillions.

A sum so massive that it is overwhelming to most people trying to get a handle on government expenditure.

The trade and the balance of payments deficits have not gotten any better either.? The slowdown in the economic growth rate in the American economy because of massive debt have only made a bad situation worse.

How is the American government funding this present fiscal problem?? Certainly not through tax receipts alone.

At present the United States can fund about 60% of its present expenditures.

The government funding of the remaining amount is the catalyst that will facilitate the? rapid decline of the dollar within a very short time frame. This will have catastrophic consequences both in the United States and throughout the world.

Happy, sad, inspiring, infuriating, right and terribly wrong, all at the same time.

Berg's film is as much an indictment of the state of Arkansas' legal system as it is the prosecution.

Berg's film helps illuminate a case that should certainly be the shame of the state of Arkansas, and perhaps the criminal justice system of the entire United States.

Dubious evidence; suspicious confessions; conveniently located "poor white trash" (Echols' words) to take the rap: The case stank from the beginning, Berg's film argues.

Less an investigative report than a portrait of the community that forms around an ongoing court case, this conveys a patient understanding of the intricacies of law and human behavior that may be termed Kieslowskian.

"West of Memphis" is the fourth film about one of the most heinous cases of wrongful conviction in American judicial history. Do we need a fourth film? Yes, I think we do.

(Director Amy) Berg's doc is gripping, often infuriating, but in the end hopeful about the ability of truth and innocence to prevail thanks to the efforts of those who strive against all obstacles to uphold them.

The new film is largely a recap of the older ones, with more celebrity testimonials and fewer Metallica songs but little fresh insight into the miscarriage of justice it chronicles.

Extols the efforts of celebrities to win the release of three innocent men [and is] suspenseful when it's straightforward-the best CSI investigation that money can buy.

Nearly overwhelms you with hopelessness, if not an adrenaline rush of rage - even if you're familiar with the case.

It's a beautifully done piece of work in its own right, yet viewed beside the trilogy which preceded it, it comes across a bit like "Paradise Lost 3b - the Celebrity Edition."

A whodunit in which truth devastatingly becomes a luxury.

New evidence and a fresh perspective keep the subject matter compelling.

Filmmaker Amy Berg (Oscar nominated Deliver Us From Evil) has once again struck documentary gold with her hard-hitting journalistic feature, West of Memphis.

A lot of it is treading on ground that's been laid by other people, but there's a lot of great new stuff, too.

The infuriating facts in this famous case are illuminated with new human detail.
